Under Section 67 of the IT Act, it is a crime to upload pornographic content on an electronic platform. If caught for the first time, there can be a jail term of up to 3 years and a fine of up to Rs 5 lakh.
If the same person does it again, the punishment increases even more. Apart from this, Section 67A is even more stringent. Under this, if sexually explicit content is uploaded, then for the first time itself, a jail term of 5 years and a fine of up to Rs 10 lakh can be imposed.
In such cases, sections of the Indian Justice Code also apply. If someone spreads pornographic content, then he can be jailed for up to 2 years and fined. The punishment for showing such content to children is even more severe. The court gives strict verdicts in such cases.
YouTube's own guidelines are also clear. On uploading pornographic or sexual content, the video is first removed. Then a warning is given. And if someone does this repeatedly, then the channel is closed forever. YouTube policy is very strict regarding this.
If a user reports such a video after seeing it, then YouTube investigates that video. If needed, the platform itself also contacts legal agencies. That is, it can be said that uploading pornographic videos on YouTube can not only get you banned from your channel but can also lead to jail and fine.
